When in spite of a failure to file a renewal request on Form TM-R with the appropriate charge, a trade mark is withdrawn from the registry, the owner of that trade mark may apply to restore it to the register and to renew the registration thereof. Such a request for restoration can be made in addition to the applicable renewal fee, within six months and one year after the expiry of registration under FormTM-R with an INR 9000 restore fee per class.
However it is necessary to remember that when evaluating the application for such recovery and renewal, the Registrar shall determine the interest of those individuals involved. The registrar shall notify the licenced proprietor of the same thing after approving the restore and renewal requests, and each registered customer shall notify the repair and renewal in the Trademarks Journal guaranteeing the renewal of the label for the corresponding duration of 10 years.
An order to guarantee the restitution of a trade mark is provided upon submission of form TM- R at a specified cost. When restoring the name, the licenced owner is notified of the same thing, and any person registered is also notified by the Trademark Journal for restoring the product.
Registration of trademarks shall be valid for 10 years from the date of registration. For every 10 years hence the label can be further renewed
The application must be received on or before 6 months before the end of the registration. The renewal application may be filed. A renewal application, in addition to the necessary late renewal fees, can also be filed within 6 months after the expiration of the renewal period.
